No Charges in "Mexican Piss" Incident; SPD to Launch Internal Investigation

By Erica C. Barnett December 14, 2010

City Attorney Pete Holmes said today that he would not file criminal charges against SPD Detective Shandy Cobane and Officer Mary Woollum in an infamous incident last spring, in which Cobane beat and kicked a Latino man suspected of robbing a man with a machete in the parking lot of the China Harbor nightclub. Cobane was caught on videotape yelling, "get your fucking head on the ground ... you got me? I will beat the Mexican piss out of you, you feel me homie?"

In a statement, Holmes said, "Though the incident was marred by an unacceptable and unnecessary racist comment, our office concludes that neither officer’s conduct was criminal, and I decline to file misdemeanor charges."

Previously, the King County Prosecutor's Office declined to file hate-crimes charges against Cobane.

In a statement, Police Chief John Diaz announced that the Office of Professional Accountability, the city office that investigates allegations of police misconduct, will conduct an internal investigation into the incident and decide whether the officers should be disciplined. "I have directed that this internal investigation be given immediate priority and will proceed with all due thoroughness and speed," Diaz said. "Discipline for a sustained complaint may include suspension, demotion or termination."
