Extra Fizz: Burgess Clarifies Panhandling Legislation
City Council member Tim Burgess has amended his proposed legislation restricting aggressive panhandling to address one of the most widely criticized aspects of the proposal—the provision barring panhandling of any person within 15 feet of a person who is using an ATM or parking meer. Critics predicted that provision was so broad it would inevitably invite a lawsuit.
The new provision bars panhandling "from within 15 feet any person who is using an automated teller machine (ATM) or a public or private parking pay station."
