Offering closing arguments Monday, prosecutors told the King County jury they were left with two possibilities: Rey Alberto Davis-Bell is either the unluckiest guy alive, or he killed Philadelphia Cheese Steak owner Degene Berecha.

That slaying, Senior Deputy Prosecutor John Castleton told the jury, was preceded earlier on Jan. 30, 2008, by an attack in West Seattle.

Addressing the jury, defense attorney Peter Geisness argued that his client had not been sufficiently tied to any of the shooting scenes.

Though two of the surviving shooting victims later identified Davis-Bell as the gunman, Geisness said other witnesses described a much taller man. Davis-Bell stands only 5-foot, 4-inches tall.
